SUMMER RAFFLE EVENT

Rules filed with Me Rémi SIMHON, Judicial Commissioner, whose office is located at 92, rue d’Angiviller – 78120 Rambouillet (France).

ARTICLE 1 - GAME ORGANIZATION

1.1 Purpose

The company METAFIGHT (hereinafter referred to as "the Organizing Company") organizes the competition among the MetaFight player community (hereinafter referred to as "the Game") from 01/08/2023 to 11/09/2023 inclusive, according to the terms described in these rules.

1.2 Acceptance of the Rules

Participation in the Game implies full acceptance of these Rules (hereinafter "the Rules") and the Terms of Use and/or Sale of the Site without reservation.

The participant in the Game (hereinafter referred to as "the Participant") is informed that the Game Rules and Terms of Use and/or Sale of the Site may be updated at any time. Any subsequent modifications to the Rules and/or Terms of Use and/or Sale of the Site will be binding on the Participant from the date of their publication.

ARTICLE 2 - CONDITIONS OF PARTICIPATION

Participation in the game is open to any adult natural person, with full legal capacity, on the starting date of the game, who has internet access, a Wallet, a user account on the Site, and resides in a country where such contests are authorized.

Employees, personnel of the Organizing Company, and their families, as well as anyone involved in the development of the Game, are not allowed to participate.

ARTICLE 3 - PARTICIPATION PROCEDURE

The Game takes place on the Platform [https://metafight.com/].

To participate in the Game, the Participant must connect their Wallet to the Site and have provided their email address or connected their Google, Discord, or Instagram account via the Platform.

The Participant must validate their participation by checking the mandatory boxes accepting the Terms of Use/Sale of the Site, these Rules, and the Site's privacy policy.

Anyone failing to meet these conditions or refusing to justify them will not be allowed to participate in the Game and/or claim any prize.

This Game is limited to one entry per natural person. Non-compliance with this provision of the Rules will result in the elimination of all entries from the Participant.

It is strictly forbidden to transfer Tickets between different accounts. Any Ticket transferred without a purchase process will result in the immediate disqualification of the relevant account.

The Game is open to Participants residing in a country where such contests are authorized by law. Participants are responsible for familiarizing themselves with the laws of their country of residence regarding contests before participating. The Organizing Company declines all responsibility in case of participation in the Game in a country where contests are prohibited.

ARTICLE 4 - GAME PROCEDURE

4.1. Eligibility

To be eligible to participate in the Game, Participants must accumulate tickets (hereinafter "the Tickets") by reaching certain positions in the leaderboard (hereinafter "the Leaderboard") or by scoring at least fifty (50) points in the Championship arena.

For the Starter arena, the number of Tickets allocated to each position in the Leaderboard will be as follows: 1st: four (4) Tickets 2 to 5: three (3) Tickets 6 to 10: two (2) Tickets 11 to 25: one (1) Ticket

For the Championship arena: 1 to 5: five (5) Tickets 6 to 28: four (4) Tickets 29 to 75: two (2) Tickets 76 and below [50 points scored]: one (1) Ticket

4.2. Ticket Distribution

The Game is divided into episodes (hereinafter "the Episode"): Episode 1: from August 1st to August 11th Episode 2: from August 11th to August 22nd Episode 3: from August 22nd to September 1st Episode 4: from September 1st to September 11th

Each Episode will allow Participants to access a Leaderboard. In total, the Game will consist of four separate Leaderboards, and Tickets will be awarded based on the position achieved in the four Leaderboards.

Each Episode does not entitle the Participant to receive prizes related to the Game (except for prizes awarded on the Platform as usual) but only Tickets based on the position held in each Leaderboard. The prizes will be awarded at the end of the Game, during the draw.

Tickets will be distributed and sent to the digital wallet of each participant (hereinafter "the Wallet"). To be eligible to receive Tickets, a Participant must have linked a Wallet to a MetaFight account. The more Tickets a Participant has, the more chances they have to win a Prize in the draw. However, a maximum of six (6) Tickets per Participant will be counted for the draw.

4.3. Validation of Tickets

Participants will receive their Tickets in their Wallet during the Game period. To validate their participation, Participants must send their Tickets to the address "metafight-raffle.eth" (0x6b9951c8D137B0216eF78F66cAb706f004aF707c) after the Game's closing, between September 11th and September 15th.

A maximum of 6 (six) Tickets can be sent per Participant.

Tickets are valid until the date of the draw.

4.4. Draw

The draw will take place in the week of September 11th, under the supervision of a Judicial Commissioner, whose contact information is as follows: Me Rémi SIMHON, located at 92, rue d’Angiviller – 78120 Rambouillet (France).

Each Participant can only win one Prize.

The names of the winners will be announced on the social media of the Organizing Company, and the winners will be individually informed of their winnings by private message on the email address or SSO account associated with their MetaFight account (Google, Discord, or Instagram).

ARTICLE 5 - PRIZES

The prizes will consist of 20 (twenty) prizes to be won (hereinafter "the Prizes"). The awarded Prizes will be playable NFTs exclusively on the Platform.

By way of example, these prizes may correspond to unique fighter cards, unique equipment cards, or legendary packs.

These Prizes will be awarded by drawing lots, based on the ranking in each Leaderboard.

ARTICLE 6 - ALLOCATION OF PRIZES

Participants authorize the Organizing Company to verify their identity.

From the date of notification of their winnings by the Organizing Company, via a private message to the email address or SSO account (Google, Discord, or Instagram) associated with their MetaFight account, the winner of the Game has a period of fifteen days to provide the Organizing Company with a copy of their identity card and a proof of address, so that it can verify their majority and their residence in a country allowing participation in contests.

The Prizes will be sent to the winner by the Organizing Company to the associated Wallet.

If the winner fails to provide the required documents within the specified period, this will be considered a waiver on their part, and the prize may, at the Organizing Company's discretion, be put back into play or awarded to a winner from the waiting list.

The Participant is free to refuse the prizes won. No compensation will be granted in case of refusal of the prize.

The Organizing Company shall not be held responsible for the use or non-use, or even the trade, of the prizes by a winner.

In the event of force majeure, the Organizing Company reserves the right to replace the prize won with a prize of equivalent nature or value.

ARTICLE 7 - EXCLUSION OF A PARTICIPANT FROM THE GAME

Any fraud or violation by a Participant of any provision of these Rules or the Terms of Use/Sale of the site may result in their temporary or permanent exclusion from the Game by the Organizing Company, which reserves the right to take legal action against them if necessary.

Such exclusion, whatever the cause, will result in the cancellation of the registration of the Participant concerned and their potential winnings.

ARTICLE 8 - INTERRUPTION OF THE GAME

The Organizing Company undertakes to make every effort to ensure the smooth running of the Game.

The Organizing Company reserves the right to extend the operation or to modify its terms or to cancel it if necessary.

The Organizing Company may cancel all or part of the Game if it appears that fraud has occurred in any form, including computer fraud, in the context of participation in the Game. In this case, it reserves the right not to award prizes to fraudsters and/or to pursue the authors of such fraud before the competent courts.

The Organizing Company's liability cannot be engaged, and no compensation of any kind will be paid to participants if a technical failure occurs and affects the smooth running of the game under conditions beyond its control or in case of modification or cancellation of the game.

ARTICLE 9 - PROCESSING OF PERSONAL DATA

The personal data provided by the Participant as part of their registration for the Game and during their participation in the Game, particularly on their Platform, are essential for participation in the Game.

Participants are informed that their personal data is processed with their consent.

The Participant's personal data is collected, processed, and used for the following purposes:

• to consider their participation in the Game,

• to monitor participation in the Game and interactions between Participants,

• to identify winners and contact them for the purpose of awarding prizes,

• if applicable, to manage prospecting and commercial communication, with the consent of Participants, to send preferential information and commercial offers,

• to manage any claim or possible fraud.

Personal data is collected on the website [https://metafight.com/].

The Organizing Company may also use personal data to comply with applicable laws and regulations.

This data may not be used for other purposes and will be kept for a period of three (3) months from the end date of the Game.

In accordance with Regulation 2016/679 of April 27, 2016, and Law No. 78-17 of January 6, 1978, relating to information technology, files, and freedoms (known as the "Data Protection Act"), as amended by Law No. 2018-493 of June 20, 2018, on the protection of personal data (GDPR), you have the right to access, rectify, delete, and port your data, as well as the right to object to and limit the processing of your data and the right to determine the fate of your data after your death. You can withdraw your consent to the processing of your Data at any time. These rights can be exercised by writing to the Organizing Company, specifying the name of the operation, at the following address, or if you have any questions about our privacy policy or how we process your Personal Data, please contact us:

Individuals who exercise their right to delete, object, or withdraw their consent before the end of the Game will be deemed to have waived their participation.

ARTICLE 10 - ACCESS TO THE RULES

The rules will be directly available on the MetaFight Gitbook, accessible on the Site [https://metafight.com/], and will be available throughout the duration of the Game. The Game rules can also be sent to anyone who requests them from the Organizing Company by email.

ARTICLE 11 - ENTIRETY OF THE RULES

In the event that any provision of these Rules is declared null or void, this shall in no way affect the validity of the rules themselves.

ARTICLE 12 - APPLICABLE LAW AND JURISDICTION

These rules are subject to French law.

In case of dispute or claim, for any reason whatsoever, requests must be sent to the Organizing Company within one (1) month after the closing of the Game (postmark being proof).

Any claim must be made in writing exclusively, sent by postal mail to the following address: 50 avenue Daumesnil – 75012 Paris, France.

Any dispute arising in connection with this Game shall be subject to the competent French courts.
